Terms and Conditions of Use – Human Element Pass

These Terms and Conditions regulate access to and use of the application and services associated with the Human Element Pass (hereinafter, "the App"), provided by:

By using the App, you accept these Terms and Conditions. If you do not agree, you should not use it.
1. Scope and relationship with corporate contracts
Access to the Human Element Pass is linked to a framework contract between The Human Element Studio SL (hereinafter, "Human Element") and the user's employer (hereinafter, "the Company").
In the event of any contradiction between these Terms and the contract signed with the Company, the provisions of the contract shall prevail.
These Terms apply to the direct relationship between Human Element and the end user in the use of the App and its services.
2. Description of the service
The Human Element Pass is a digital pass that grants employees of contracted Companies access to cultural, educational, and well-being experiences curated by Human Element.
3. Use of credits
Credits are valid for 12 months from their assignment and are not cumulative to the following period.
Each experience has a credit value indicated in the App.
Restrictions on use (minimum/maximum participants, specific conditions) will be indicated in the description of each experience.
Credits not used within their validity period will expire with no right to reimbursement.
4. Reservations and cancellations
Reservations are managed through the App or by email.
Provider cancellations: credits will be fully refunded.
User cancellations: if made less than 7 days in advance, the credits used will be lost.
Human Element does not guarantee the availability of experiences on specific dates.
5. Collaboration of the parties
The Company shall designate an internal representative to coordinate the use of the App and provide necessary information.
The user agrees to provide truthful information and to use the App correctly.
6. Role of Human Element
In some experiences, Human Element acts as the organizer, and in others as an intermediary between the provider and the user.
In all cases, responsibility for executing the experience lies with the provider delivering it.
7. Payments
The cost of credits and access to the App is borne by the Company.
The end user will not make payments through the App.
8. Acceptable use
The following is prohibited:
Using the App or credits for unlawful or fraudulent purposes.
Reselling or transferring credits or tickets without authorization.
Falsifying data or identity.
9. Intellectual property
All pre-existing content of Human Element (texts, images, guides, software, etc.) is the exclusive property of Human Element or its licensors.
The user receives a limited, non-exclusive, non-transferable right of use, exclusively for the purpose provided in these Terms and during their validity.
10. Subcontracting
Human Element may engage third-party providers and subcontractors to deliver experiences and services, ensuring they comply with the obligations set out in these Terms.
11. Data protection
Controller: The Company is responsible for the data of its employees; Human Element acts as a processor to provide the service.
Purpose: manage access, reservations, and monitoring of experiences.
Data processed: name, email, company, experience history, and credit usage.
Retention: for the duration of the contractual relationship and the applicable legal period.
Rights: access, rectification, erasure, objection, restriction, and portability by contacting support@humanelement.studio.
12. Limitation of liability
Human Element acts with due diligence but does not guarantee uninterrupted service availability.
It shall not be liable for indirect or consequential damages.
The total liability of Human Element, in case of a claim, shall not exceed the value of the services actually paid by the Company in the previous year.
Accidents during experiences must be covered by the provider's or the Company's insurance.
13. Force majeure
Human Element shall not be held responsible for non-compliance due to force majeure, such as natural disasters, strikes, armed conflicts, or failures of external services.
14. Confidentiality
All information marked as confidential and shared between Human Element, the Company, or the user shall be treated with strict confidentiality and shall not be disclosed without prior authorization, except where legally required.
15. Jurisdiction and applicable law
These Terms are governed by Spanish law. For dispute resolution, the parties submit to the Courts of Barcelona, unless consumer protection regulations establish another jurisdiction.
